MinnesotaTeam.com provides real estate information, property search tools, marketing information, educational content, and other resources for consumers. Nothing on this website, by itself, creates an agency, brokerage, fiduciary, or other professional relationship between you and MinnesotaTeam or any real estate professional unless and until such a relationship is expressly established in accordance with applicable law.

Real estate information displayed on MinnesotaTeam.com may include information obtained from the Regional Multiple Listing Service of Minnesota, Inc. (“RMLS”), d/b/a NorthstarMLS, property owners, public records, third-party data providers, brokers, agents, and other sources. Information is deemed reliable but is not guaranteed. Property information, including price, availability, status, dimensions, features, photographs, remarks, taxes, assessments, and other information, may change without notice and may contain errors or omissions.

You should independently verify any information that is important to you before relying upon it, including property availability, pricing, measurements, taxes, assessments, zoning, permitted uses, school information, financial information, and other property characteristics. Information displayed on this website should not be relied upon as a substitute for independent investigation, professional advice, or appropriate legal, financial, tax, inspection, appraisal, title, survey, insurance, or other professional services.

MLS and Broker Reciprocity Content

Certain property information displayed on MinnesotaTeam.com may be provided through RMLS and its Broker Reciprocity program. Access to and use of such information is subject to the End-User License Agreement required by RMLS, which is incorporated into these Terms by reference where applicable.

The RMLS End-User License Agreement governs your access to licensed MLS content and imposes additional restrictions on the use, reproduction, distribution, disclosure, scraping, and other handling of that information. Where required, you must affirmatively agree to the RMLS EULA before accessing MLS content.

All rights in RMLS and other third-party MLS content remain with the applicable owners and licensors. Nothing in these Terms grants you ownership of or any right to commercially exploit MLS data, photographs, listing information, or other third-party content.

MLS and property information is provided for your personal, non-commercial real estate purposes. You may not copy, reproduce, redistribute, sell, license, publish, scrape, harvest, download in bulk, or otherwise commercially exploit MLS data or other protected property content except as expressly permitted by the applicable owner or licensor.

You may not use automated systems, bots, crawlers, spiders, scripts, scraping tools, or similar technologies to access, collect, reproduce, monitor, or extract information from MinnesotaTeam.com or its data sources without our prior written authorization and any authorization required by the applicable data provider.

Website Use

You may use MinnesotaTeam.com only for lawful purposes and in accordance with these Terms.

You may not use the website to violate any applicable law or regulation; interfere with the operation or security of the website; gain unauthorized access to any system, account, database, or network; introduce malicious code; impersonate another person or entity; collect information about other users without authorization; infringe intellectual property or privacy rights; or otherwise interfere with the website or its users.

Accounts and User Information

Certain features may permit or require you to provide information to us or create an account. You are responsible for providing accurate information and for maintaining the confidentiality of any account credentials.

You are responsible for activity conducted through your account to the extent permitted by applicable law. You must promptly notify us if you believe your account or credentials have been accessed or used without authorization.

You must be at least eighteen (18) years of age to create an account or otherwise use services that require an account, unless expressly permitted otherwise by applicable law.

User-Submitted Content

If you submit information, photographs, reviews, comments, messages, property information, inquiries, or other materials to MinnesotaTeam.com (“User Content”), you retain ownership of your User Content.

By submitting User Content, you grant MinnesotaTeam and its service providers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and use that User Content as reasonably necessary to provide, operate, maintain, improve, and secure the services and to respond to your requests.

You represent that you have the right to provide any User Content you submit and that your submission does not violate the rights of another person or entity or applicable law.

We reserve the right to remove or decline to publish User Content that we believe violates these Terms, applicable law, third-party rights, or the purpose of the website.

Property Information and Real Estate Services

MinnesotaTeam.com is a real estate website and may provide information relating to properties, transactions, market conditions, financing, and other real estate matters.

Nothing contained on the website constitutes legal, tax, accounting, lending, investment, appraisal, inspection, title, survey, insurance, or other professional advice.

Market data, estimates, calculations, valuations, automated estimates, comparative information, and similar materials are provided for informational purposes only and may not accurately reflect the current or future value of a property.

MINNESOTATEAM MAKES NO REPRESENTATION OR WARRANTY THAT THE WEBSITE OR ITS CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, AVAILABLE, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MINNESOTATEAM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO MINNESOTATEAM FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100).

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless MinnesotaTeam and its owners, brokers, agents, affiliates, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, your misuse of the website, your User Content, or your violation of applicable law or the rights of another person.

Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of MinnesotaTeam.com shall be governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any dispute-resolution provisions applicable to your use of the website, including any arbitration or class-action waiver provisions, shall be interpreted and enforced in accordance with applicable law.

If an arbitration provision is adopted for these Terms, it should be reviewed and approved by Minnesota legal counsel before publication and should specify the arbitration provider, applicable rules, procedures for initiating arbitration, allocation of fees and costs, location of proceedings, applicable exceptions, and the circumstances under which court proceedings remain available.

Nothing in these Terms prevents either party from seeking temporary, preliminary, or injunctive relief where permitted by law.

We may modify these Terms from time to time. When we make material changes, we may provide notice through the website or by other reasonable means.

The “Last Updated” date at the beginning of these Terms identifies the date of the most recent revision.

Your continued use of MinnesotaTeam.com following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by law.

Termination

We may suspend or terminate your access to MinnesotaTeam.com or any service at any time, with or without notice, where permitted by law.

Upon termination, provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

No Waiver

These Terms, together with the Privacy Policy, any applicable MLS End-User License Agreement, and any other terms expressly incorporated by reference, constitute the agreement governing your use of MinnesotaTeam.com with respect to the subject matter addressed herein.

Electronic Communications

By using MinnesotaTeam.com or communicating with us electronically, you consent to receive electronic communications where permitted by law. You agree that electronic communications, notices, disclosures, and agreements may satisfy legal requirements that such communications be provided in writing.

NorthstarMLS Broker Reciprocity

MinnesotaTeam.com participates in the Broker Reciprocity program of the Regional Multiple Listing Service of Minnesota, Inc. (“NorthstarMLS”). Certain real estate information displayed on this website is provided through the Broker Reciprocity program.

The data relating to real estate for sale on this website comes in part from the Broker Reciprocity program of the Regional Multiple Listing Service of Minnesota, Inc. Real estate listings held by brokerage firms other than Mike Wilen Real Estate are marked with the Broker Reciprocity logo or applicable Broker Reciprocity identification, and detailed information about those listings includes the name of the listing broker.

Information is deemed reliable but is not guaranteed. Property information, including price, status, dimensions, features, photographs, remarks, taxes, assessments, and other information, may be subject to change and may contain errors or omissions.
